Distributorship Agreement - Terms & Conditions

  1. The applicant is aware of the benefits of the MALAS Accumulation Referral Business Plan as described in the official website of MALAS.
  2. The applicant should be a major having attained the age of 18 years and when he/she joins the MALAS Accumulation Referral Business Plan of his/her own will only after thoroughly understanding the process involved.
  3. The distributorship of MALAS Accumulation Referral Business Plan will be actives after any own purchase through MALAS App.
  4. Earned income from MALAS Accumulation Referral Business Plan will be disburse or adjust as purchase amount only after achievement of greater than fifty (>50) PV from own purchase through MALAS E-Commerce website ‘www.malasselection.com’ or through 'MALAS SELECTION' android App.
  5. Minimum quarterly purchase Rs.800/- is required for active distributorship.
  6. The distributer should not force anybody to become associated with the MALAS Accumulation Referral Business Plan. The distributer should not make false promises by giving misleading information to promote MALAS Accumulation Referral Business Plan. In no way MALAS will be held responsible in any manner whatsoever for such false and misleading statements.
  7. The distributer should know that MALAS would deduct taxes which will be deductible as per law.
  8. The distributer understands that if he/she commits any act in nature of beach of trust or violation of rules formed by MALAS, MALAS reserves the right to terminate his her distributorship without assigning any reason as well will be able to impose fines/penalties etc. on the distributer. Please also be informed that the referee vouchsafes the authenticity of information and details as furnished by the distributer and if any fraud mistake or misrepresentation or fact is detected afterwards, the referee will be liable for such punishment as will be deemed fit and prefer by MALAS.
  9. It is expressly understood that distributer is not an employee of MALAS and there is no employer and employee relationship between the distributer and MALAS.
  10. The distributer will abide by the rules of MALAS Accumulation Referral Business Plan including amendments thereto, published or noticed by MALAS from time to time.
  11. MALAS expressly reserves the right to reject the distributorship registration without assigning any reason.
  12. The distributer agrees that MALAS Accumulation Referral Business Plan, as illustrated  in the official literature should be deemed to form a part of this agreement between MALAS and the distributer and that will be effective  from the date of Distributorship Agreement and will be continue to be so in amended from if any amendment is done by MALAS  in future.
  13. MALAS expressly reserves the right to change and/or amend necessary clause in the MALAS Accumulation Referral Business Plan at any point of time without any prior notice. The distributer will be informed of all the changes in the terms and conditions governing MALAS Accumulation Referral Business Plan as and when they are changed, amended, by way of notification in website.
  14. The distributer is eligible to get benefit as per MALAS Accumulation Referral Business Plan and after fulfillment of different achievements MALAS will dispatch the amount/kinds against benefit to the distributors as per the dates notified from time to time.
  15. The applicant who wants to be a distributer should be an Indian and he/she should not have any criminal case pending against him/her or he/she should not have been convicted by court of law.
  16. Customer/distributor is agreed to pay 2% system management charges at the time of online payment through payment gateway.
  17. The distributer understands that under no circumstances MALAS is responsible for the unauthorized acts committed by him/her or any other act or omissions. The distributer should indemnify MALAS for his/her unauthorized acts and he she will be liable for all costs and consequence according to law.
  18. Nominee would be treated only heir in case death of distributer and no structural changes are possible once any introduction of any distributer is fed into the system.
  19. Usage of logo and embalmed of MALAS without permission is strictly prohibited for promotion of MALAS Accumulation Referral Business Plan by the distributer.

Terms and conditions Of RPV(Redeemable Product Voucher) purchase through instalment/single payment:-

  1. 1 PV = Rs.4000/- would be considered at the time of RPV purchase and All RPV are useable for product purchase but non-refundable from RPV wallet.
  2. 2% system management charges would be applicable on RPV purchase price at the time of online payment through payment gateway.
  3. Customer/Distributor can purchase any RPV of Rs.3000/-, Rs.4500/-, Rs.6000/-, Rs.9000/-, Rs.12000/- and Rs.15000/- through 6 equal monthly instalment.
  4. Customer/Distributor can purchase RPV of Rs.500/- by single payment.
  5. Rs.15000/- is the maximum upper limit for purchase of RPV through instalment facility.
  6. Customer/Distributor is eligible to purchase any single RPV at a time through instalment facility.
  7. Customer/Distributer can avail instalment facility further after completion their pending payment.
  8. In case of EMI payment if any Customer/Distributer become defaulter to fulfil the RPV value within scheduled maximum allowable tenure, then the sum of his/her earlier paid EMI which they deposited in their wallet is adjustable for future purchase but non-refundable from RPV wallet.

JURISDICTION : Any dispute arising between the MALAS and the distributer will be decided according to the arbitration conciliation Act 1996 and the place of jurisdiction shall be Kolkata city only.

DECLARATION

I hereby declare that I am a major and am competent to execute this agreement. I hereby confirm having gone through, read and understood the above Terms & Conditions and that I shall abide by the same and the same is acceptable to me. I am executing this agreement through my free will only.
